By entering the sweepstakes by mobile phone you agree to receive additional text messages related to this promotion, including a confirmation text message, prompt to vote and a text message and/or phone call to notify you if you are a potential winner of the sweepstakes.. Entrants agree that Sponsors will not be responsible or liable for:
• Mechanical, human, printing, production, or distribution errors in the administration or fulfillment of this Sweepstakes or in any Sweepstakes-related materials and may cancel, suspend, terminate, or modify this Sweepstakes based upon such error at their sole discretion and
• Technical, electronic, equipment, hardware, software, cable, telephone or satellite malfunctions of any kind; lost or unavailable network or telephone connections, viruses; any error, omission, interruption, defect, or delay in transmission or communication; or failed, incorrect, incomplete, inaccurate, garbled or delayed electronic communications caused by the Sponsors, the entrant’s mobile phone, or by any of the equipment or programming associated with or utilized in the Sweepstakes or by any human error that may occur in the processing of the entries or administration of the Sweepstakes and/or which may limit an entrant's ability to participate in this Sweepstakes.
One (1) Potential Winner will be selected in a random drawing from all eligible entries on or about November 27, 2007, and will be notified by e-mail and/or telephone or text message, depending on method of entry. If potential winner cannot be contacted, does not respond within three (3) days of receiving notification, or the prize or notification is returned as undeliverable, such potential winner forfeits all rights to any prize, and an alternate winner may be selected. The prize, if properly claimed, will be awarded. All decisions of the judges are final and binding in all respects. The Grand Prize is roundtrip coach airfare for two (2) from a major commercial airport nearest the winner’s primary residence in the U.S. to Los Angeles, CA, one (1) standard hotel room (double-occupancy) for three (3) nights in Los Angeles at a hotel to be chosen by Sponsors, one (1) consultation with an Los Angeles. stylist, (including an outfit to wear (valued up to $750) to the premiere (timing TBD) opportunity to attend the premiere of a film and walk the red carpet (attendance at the premiere and walking the red carpet are contingent on availability and timing), admission to selected top lounges/clubs and ground transportation. The approximate retail value of the prize is $5,000, depending on exact itinerary. Actual value may vary based on airfare fluctuations and distance between departure point and destination. Other ground transportation, meals, beverages, in-room personal charges at the hotel (e.g., mini-bar, movies), telephone calls, gratuities, incidentals, and all other expenses are not included. May be subject to certain restrictions and blackout dates. Winner and travel companion must be available to travel on the same itinerary as selected by Sponsors. Trip must be completed by December 31, 2008. If winner is a minor in his/her state of residence, winner must be accompanied by his/her parent or legal guardian and parent or legal guardian shall execute all documents. If in the sole judgment of Sponsors, air travel is not required due to winner’s proximity to prize location, ground transportation will be substituted for roundtrip air travel.
3. Income and other taxes on the prize are the sole responsibility of the winner. Winner shall be required to complete a W-9 Tax Form.
4. The Sweepstakes is open only to legal residents of one of the 50 United States or District of Columbia who are 13 years of age or older as of the date of entry. Employees and immediate family members of Sponsors or Moxie Interactive are not eligible to enter.
5. This Sweepstakes is subject to all federal, state, and local laws and regulations. Void outside the 50 United States and the District of Columbia, and where prohibited. Any violation of these rules may result in disqualification.
6. The odds of winning depend on the number of entries received. The grand prize is not transferable or redeemable for cash, except at Sponsors' sole discretion. No substitutions for prize except by Sponsors in which case a prize of equal or greater value will be substituted.
7. All entries become the property of Sponsors and will not be acknowledged or returned. By providing your e-mail address and cell phone number, you grant Sponsors the right to send you commercial messages and to share your address with others, unless specified otherwise, as indicated on the entry form.
8. Except where prohibited: (i) participation in the Sweepstakes constitutes consent for the Sponsors and the Released Parties (defined below) to use winner's name, likeness, city and state of residence, image, photograph, and biographical data for editorial, advertising, publicity, and trade purposes, and any other purpose in any media or format now or hereafter known (including, without limitation, the internet and mobile phone) without further compensation, review, permission, or notification; (ii) potential winner will be required to execute and return an Affidavit of Eligibility (including social security number) and Liability/Publicity release; (iii) potential winner (and travel companion) will be required to execute releases of Sponsors from any and all liability with respect to participation in the Sweepstakes and/or use of the prize. The Affidavit of Eligibility and Liability/Publicity release must be returned within ten (10) days of receipt or an alternate winner may be chosen.. Non-compliance with any of the foregoing may result in disqualification and awarding of the grand prize to an alternate winner.

Entrants agree that: SPONSORS, THEIR RESPECTIVE PARENT COMPANIES, AFFILIATES, DISTRIBUTORS, SUBSIDIARIES, ADVERTISING/PROMOTION AGENCIES, DESIGNEES AND ASSIGNS, AND ALL OF THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, REPRESENTATIVES AND AGENTS (COLLECTIVELY, "RELEASED PARTIES") SHALL HAVE NO LIABILITY AND WILL BE INDEMNIFIED, DEFENDED AND HELD HARMLESS BY ENTRANTS FOR ANY LIABILITY, LOSS, COST, FEES (INCLUDING ATTORNEYS' FEES), INJURY OR DEATH TO ENTRANT, GUEST(S) OR ANY OTHER PERSON, INCLUDING, WITHOUT LIMITATION, DAMAGE TO PERSONAL OR REAL PROPERTY, DUE IN WHOLE OR IN PART, DIRECTLY OR INDIRECTLY, BY REASON OF THE ACCEPTANCE, POSSESSION, USE OR MISUSE OF THE GRAND PRIZE.

NEITHER SPONSORS NOR ANY OF THE RELEASED PARTIES HAVE MADE OR ARE IN ANY MANNER RESPONSIBLE OR LIABLE FOR ANY WARRANTY, REPRESENTATION, OR GUARANTEE, EXPRESS OR IMPLIED, IN FACT OR IN LAW, RELATIVE TO THE GRAND PRIZE OR THE USE THEREOF, INCLUDING, WITHOUT LIMITATION, ANY EXPRESS OR IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR ANY PURPOSE, OR TITLE.
11. By participating, each entrant agrees to not knowingly: damage or cause interruption to the Sweepstakes; or prevent others from participating in the Sweepstakes. Any attempt to damage or undermine the legitimate operation of this Sweepstakes violates criminal and/or civil laws. If such an attempt is made, Sponsors may seek damages to the fullest extent permitted by law. Non-compliance with any of the foregoing may result in disqualification and awarding of prize to an alternate winner.
