The Verizon Wireless NHL Winter Classic TXT2WIN Sweepstakes (the “Sweepstakes”) begins at 12:00:01 a.m. Eastern Standard Time (“EST”) on December 1, 2008 and ends on December 22, 2008 at 11:59:59 p.m. EST ("Sweepstakes Period").
Eligibility: This Sweepstakes is open to legal U.S. residents or the District of Columbia who are at least 18 years of age or the age of majority in the participant’s state of residence at the time of entry, and who are Verizon Wireless subscribers. Employees, officers, and directors (and members of the immediate families or households of each) of Verizon Wireless (“Sponsor”), Vibes Media LLC (the “Administrator”), the National Hockey League, the NHL member clubs, NHL Enterprises, L.P., NHL Enterprises Canada, L.P., NHL Enterprises B.V., and NHL Interactive CyberEnterprises, LLC (such NHL entities, collectively, the “NHL Entities”), their respective affiliated companies, subsidiaries, distributors, printers and advertising and promotion agencies, and any and all other companies associated with this Sweepstakes, and the immediate family members and household members (whether or not related) of such persons, are not eligible to participate. Void in Puerto Rico, the U.S. Virgin Islands, U.S. Military installations in foreign countries, anywhere outside of the U.S., and where prohibited, taxed, or restricted by law.
How To Enter: To enter the Sweepstakes entrants must do one of the following:
A. VIA TEXT: If you are a Verizon Wireless subscriber, during the Sweepstakes Period, send the keyword “SHOOTOUT” using the text messaging feature on your Verizon Wireless handset to Verizon Wireless addressed to the number 3408. Once the text message is received, you will be automatically entered into the Sweepstakes. Limit one entry per person via mobile phone method. All entrants must have a text messaging two-way capable handset and digital service in order to enter the Sweepstakes using the text messaging method. Verizon Wireless charges are up to 20¢ per domestic text message sent and received. If you subscribe to a Verizon Wireless TXT Messaging plan, usage will be deducted from your plan’s allowance; excess usage will be billed at 10¢ per text message sent and received. Verizon Wireless Prepay subscribers are charged 10¢ per text message sent and received. Sponsor is not responsible for charges you may incur as a result of text messages or other mobile phone messages. Text messaging and Verizon Wireless service are not available in all areas.
B. Enter for Free Online: If you are a Verizon Wireless subscriber during the Sweepstakes Period and wish to enter for free without sending a text message, visit www.verizonwireless.com/nhl and accurately complete and submit the information requested on the online registration form including name, age, a valid email address and mobile telephone number (“MTN”). Limit one online entry per person/per household/per email address regardless of whether one person has more than one email address or more than one person uses the same email address. All entries become the property of the Sponsor and will not be acknowledged or returned, and no correspondence will be entered into. Limit one entry per person regardless of method of entry. All entries must be received by 11:59:59 p.m. EST on December 22, 2008.
Random Drawing: On or around December 23, 2008, a Grand Prize Winner will be selected, in a random drawing conducted by the Administrator, from among all eligible entries received during the Sweepstakes Period. Sponsor will attempt to notify potential winner by mobile telephone number and/or email on or around December 23, 2008. The Administrator’s decisions are final and binding on all participants with respect to the Random Drawing. The potential Grand Prize Winner must meet all eligibility requirements set forth in these rules to qualify for a prize. Odds of winning depend on the number of eligible entries received.
Prize: One Grand Prize Package shall consist of: One (1) 2-night/3-day trip for the Grand Prize Winner and one guest to attend the NHL Winter Classic Game scheduled to be held in Chicago, Illinois on January 1, 2009 (“Game”). In the event the guest is a minor in his/her state of residence, he/she must be accompanied by an adult who is his/her parent or legal guardian. The trip includes round-trip economy class air transportation for two (2) from a major commercial airport nearest Grand Prize Winner’s home to Chicago, IL; two (2) nights’ hotel accommodations at the Intercontinental Hotel (one standard room, double occupancy) as determined by the Sponsor; two (2) tickets to the NHL Winter Classic open practice on December 31, 2008; two (2) tickets to New Year’s Eve Party at the House of Blues; two (2) tickets to the NHL Winter Classic game on January 1, 2009; and two (2) NHL $500 Gift Cards. Approximate Retail Value (“ARV”) of Grand Prize package: $4,206.00. Grand Prize Winner is responsible for all meals, beverages, and any other expenses not listed above. Actual value may vary based on air transportation fluctuations and distance between departure and destination travel. If the actual ARV for the Grand Prize is less than the foregoing ARV, the Grand Prize winner is not entitled to the difference.
Grand Prize Winner and guest must travel on the same itinerary and must be willing and able to travel on dates specified by the Sponsor or Grand Prize will be forfeited and awarded to an alternate winner. Upon forfeiture, no compensation will be given. Prize details and availability are subject to change, in which case a prize of equal or greater value may be substituted at Sponsor’s sole discretion. All travel arrangements must be made through a travel agent designated by Sponsor. No refund or compensation will be made in the event of the cancellation or delay of any flight except at the sole discretion of the Sponsor. In addition, the Grand Prize Winner and his/her travel companion will be responsible for obtaining all required travel documents as well as travel insurance (and all other forms of insurance) that they may wish to obtain (at their own expense) and hereby acknowledge that the Sponsor has not and will not obtain or provide travel insurance or any other form of insurance. If you are not the age of majority in the jurisdiction in which you reside, you will need to obtain permission from your parent or legal guardian in order to be declared a Winner and your parent or legal guardian must accompany you on the trip.
Grand Prize is non-transferable except at Sponsor’s sole discretion. Except as set forth above, no substitutions or cash redemptions will be awarded. All federal, state and local taxes are the responsibility of the Grand Prize Winner. All other costs and expenses not expressly listed as part of a prize are solely the responsibility of the winner. If the Grand Prize Winner lives less than 200 miles from Chicago, IL, ground transportation will be provided in lieu of roundtrip air.
Claiming prize: Potential Grand Prize Winner will be required to complete and submit an affidavit of eligibility and a liability/publicity and travel release within 3 days of receipt of affidavit. Grand Prize Winner’s travel companion must sign a liability/publicity and travel release. If a companion is a minor, then his or her respective parent or legal guardian will be required to execute the affidavit acknowledging, confirming and consenting to the eligibility and liability/publicity and travel release. Properly claimed prize will be awarded. Acceptance of the prize also constitutes permission to use Grand Prize Winner’s name, biographical information, voice and/or likeness for Sponsor’s and/or any NHL Entity’s promotional and/or advertising purposes without notice, permission or further compensation, to the extent permitted by law. Tennessee residents need not sign publicity releases. In the event of noncompliance with these Official Rules, or if the entrant cannot be contacted at the address on his/her prize claim form, or if notification is undeliverable, prize will be forfeited and may be awarded to an alternate winner.
Additional Terms: If you enter by text messaging, you must have a valid Verizon Wireless MTN and account. In case of dispute as to identity of entrant, entry will be declared made by the Authorized Account Holder of the MTN. "Authorized Account Holder" is defined as the natural person who is assigned a MTN by Verizon Wireless or as shown on Verizon Wireless' records.
If you enter online, in the event of a dispute regarding entries received from multiple users having the same online entry account, you will be required to provide the name of the authorized subscriber of the online entry account at the time of entry and that person will be deemed to be the entrant and must comply with these Official Rules. In such case, online entry information will be declared made by the Authorized Online Account Holder of the telephone number/email address submitted at the time of entry. "Authorized Online Account Holder" is defined as the natural person who is assigned to a telephone number/email address by a telephone company, wireless service provider, Internet access provider, Internet service provider or other organization (e.g. business, educational, institution, etc.) that is responsible for assigning email addresses, telephone numbers or wireless phone numbers for the telephone exchange associated with the submitted telephone number/email address or the domain associated with the submitted telephone, as applicable. Any other attempted form of entry not specified herein is prohibited; no automatic, programmed; robotic or similar means of entry are permitted.
Conditions: By participating in this Sweepstakes, participants agree to be bound by these Official Rules, the decisions of the Sponsor and the decisions of the independent judges, which are final and binding in all respects. Entrants, by participating, release and agree to hold harmless Sponsor, the Administrator, the NHL Entities, and their respective affiliates, subsidiaries, distributors, franchisees, retailers, printers and advertising and promotion agencies, and directors, officers, shareholders, employees, representatives and agents (collectively, the “Releasees”) from any and all liability for any injuries, losses or damages of any kind to persons including death, and property, claims, actions, proceedings, or judgments, arising in whole or in part, directly or indirectly, from use of the Grand Prize and/or participation in any Sweepstakes-or Prize-related activity, or participation in this Sweepstakes. Releasees make no warranty, guaranty or representation of any kind concerning prize and disclaim any implied warranty.
Releasees shall not be liable to any Grand Prize Winner or any other person for failure to supply any prize or any part thereof, by reason of any acts of God; any action(s), regulation(s), order(s), or request(s) by any governmental or quasi-governmental entity (whether or not the action(s), regulation(s), order(s), or request(s) prove(s) to be invalid); equipment failure; terrorist acts; earthquake; war; fire; flood; explosion; unusually severe weather; hurricane; embargo; labor dispute or strike (whether legal or illegal); labor or material shortage; transportation interruption of any kind; work slow-down; civil disturbance; insurrection; riot; or any other cause beyond Sponsor's sole control. If the NHL Winter Classic Game is cancelled, rescheduled, delayed or postponed, in whole or in part, Sponsor has no obligation to Grand Prize Winner other than to provide the trip and prizes as described above, and the NHL Entities shall have no obligation to provide any form of prize equivalent. If unused, game tickets cannot be refunded or exchanged for cash value or substitute tickets. Terms and conditions of the game tickets and NHL Gift Cards will apply. Sponsor reserves the right to cancel this Sweepstakes at any time without obligation or prior notice.
Any personal information supplied by any entrant to Sponsor will be subject to Verizon Wireless' privacy policy posted at http:// www.verizonwireless.com/b2c/footer/privacy.jsp and terms of service posted at http://www.verizonwireless.com. Sweepstakes shall be construed only according to U.S laws. This sweepstakes shall be governed by the laws of the state of New Jersey without regard to its conflict of laws provision. All national, state and local laws and regulations apply.
Limitations of Liability: Sponsor not responsible for lost, late, illegible, or misdirected registrations or entries. Sponsor reserves the right, at its sole discretion, to disqualify any individual it finds to be tampering with the entry process or the operation of the Sweepstakes, to be acting in violation of the Official Rules, or to be acting in a non-sportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person. The use of automated or third-party software or website to register and/or enter is prohibited, and any registrations or entries made through such methods will be disqualified. Sponsor reserves the right to void all registrations and entries made through any robotic, automatic, mechanical, programmed or similar entry duplication method and to disqualify any individual using such a method. Sponsor is not responsible for any: (a) telephone, computer, hardware, software, programming, or network malfunction or other technical failures or errors, or the failure to properly process entries; (b) communication disruption or other forces beyond the reasonable control of the Sponsor, including but not limited to disruption related to Internet traffic, virus, bug or non-authorized intervention; or (c) damage caused by computer virus or otherwise resulting to any computer from such person’s access to the website whether human, mechanical or electronic. If such malfunction, error, disruption or damage occurs, and impairs the administration, security, fairness, integrity or proper play of the Sweepstakes, Sponsor may, in its sole discretion, suspend or terminate the Sweepstakes by posting a notice on www.verizonwireless.com/nhl. If the Sweepstakes is terminated before the end of the Sweepstakes Period, the Grand Prize drawing will be conducted from among the eligible entries received prior to termination. Persons found tampering with or abusing any aspect of this Sweepstakes, or whom Sponsor believes to be causing malfunction, error, disruption or damage will be disqualified. Any attempt by an entrant to deliberately damage any website or undermine the legitimate operation of this Sweepstakes is a violation of United States law. Should such an attempt be made, Sponsor reserves the right to seek damages from any such individual to the fullest extent permitted by applicable law.
